Terms of Service
These updated Terms take effect on 8 July 2026. Until then, the previous version continues to apply. We are notifying registered users by email at least 14 days in advance, in line with section 16 below.
These Terms of Service (“Terms”) govern your access to and use of YapYapGo (“the Service”), operated by Toby Dobson Labs Ltd, a company incorporated in England and Wales (“we”, “us”, “our”). YapYapGo is a trading name of Toby Dobson Labs Ltd.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. About the Service
YapYapGo is a web-based classroom speaking practice tool for English language teachers. It provides conversation modes, student pairing, question banks, timers, and AI-generated discussion prompts to support speaking lessons.
The Service is intended for use by adult teachers and educators. By using the Service, you confirm that you are at least 18 years of age.
2. Your Account
You must register for an account to access certain features. You agree to provide accurate information and keep it up to date. You are responsible for maintaining the security of your account and password. You must notify us promptly at hello@yapyapgo.com if you suspect any unauthorised access to your account.
We may suspend or terminate your account if you provide false information or breach these Terms.
3. Subscriptions and Billing
YapYapGo offers a free tier and paid subscription plans (Basic and Premium), billed monthly. Subscriptions renew automatically unless cancelled.
Free Trials
We may offer a free trial of a paid plan (for example, a 30-day Basic trial). Unless we clearly state otherwise at the point of sign-up, our trials do not require a payment method, and we do not take any payment to start a trial. A trial does not convert into a paid subscription automatically: when the trial period ends, your account simply returns to the free tier. Any class data you created during the trial is retained but may be locked until you start a paid subscription, as described in ‘Free Tier’ below. Free trials are limited to one per person (and, for institutions, one per organisation) unless we agree otherwise, and we may withdraw or change trial offers at any time.
You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial months, but if you believe you have been charged in error, contact us at hello@yapyapgo.com within 7 days and we will review your request.
Payments are processed by Stripe. We do not store your card details. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis.
We reserve the right to change pricing with reasonable notice. You will be notified by email before any price change affects your subscription.
4. Free Tier
The free tier provides access to a limited set of features with no time restriction. If you downgrade from a paid plan to free, your saved class data will be retained and remains fully usable on the free tier.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, copy, scrape, or reproduce any part of the Service or its content without our written permission
- Use automated tools, bots, or scripts to access the Service
- Attempt to gain unauthorised access to our systems or another user’s account
- Use the Service to distribute malware or harmful content
- Resell, sublicense, or commercially exploit the Service without our express written consent
6. Intellectual Property
All content, software, question banks, design, and functionality within YapYapGo is owned by or licensed to Toby Dobson Labs Ltd and is protected by copyright and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. Nothing in these Terms transfers any intellectual property rights to you.
If you send us feedback or suggestions about the Service, you agree that we may use that feedback without restriction or compensation.
7. User Data
You retain ownership of any data you enter into the Service, including class names and student names. We process this data in accordance with our Privacy Policy.
Student information
If you enter information about your students (such as first names or nicknames), you represent and warrant that you are using the Service in a teaching capacity and that you are authorised to do so — by your school or institution where you act on its behalf, or otherwise by the relevant parent or legal guardian — including having obtained any consent required under applicable law. You agree to provide only the minimum information needed to identify students during a lesson, and we encourage you to use first names or nicknames rather than full names.
As the account holder, you are the party responsible to us under these Terms. As between you and your school, the school is the data controller of student information where you act on its behalf; otherwise you are the controller. In all cases we act as a processor on the controller’s behalf, as described in our Privacy Policy. We do not enter into a controller–processor relationship with any school or institution unless it has signed a separate institutional agreement or data processing addendum with us.
We maintain backups of data as part of our infrastructure, but you are responsible for maintaining your own records where necessary. We are not liable for any loss or corruption of data.
8. AI Features
Premium subscribers can use AI-powered features (Custom Topic and Custom Motion Topic), which use the Anthropic API to generate content. AI-generated content is provided for classroom use only. We do not guarantee the accuracy, appropriateness, or completeness of AI-generated content and accept no liability for its use.
9. Service Availability
We aim to keep YapYapGo available at all times, but we do not guarantee uninterrupted access. We may carry out maintenance, updates, or make changes to the Service at any time. We will endeavour to provide notice of planned downtime where possible.
We are not liable for any loss or inconvenience caused by interruptions to the Service.
10. Disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, our total liability to you for any claim arising from your use of the Service will not exceed the total amount you have paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
12. Indemnification
You agree to indemnify and hold harmless Toby Dobson Labs Ltd and its officers from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time for breach of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us at hello@yapyapgo.com.
Upon termination, your right to use the Service ceases immediately.
14. Dispute Resolution
We hope to resolve any concerns informally. If you have a complaint, please contact us at hello@yapyapgo.com and we will try to resolve it within 30 days.
If informal resolution fails, disputes shall be referred to binding arbitration under the Rules of the International Commercial Arbitration Court (European Arbitration Chamber, Belgium). Arbitration shall take place in London, England, conducted in English. The governing law shall be the law of England and Wales.
Nothing in this clause prevents either party from seeking injunctive relief to protect intellectual property rights or prevent unauthorised use.
15. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute not referred to arbitration.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
17. Data Processing
This section applies where we process personal information relating to your students on your behalf (or on behalf of your school or institution). It sets out the terms on which we act as a “processor” and you (or your school) act as the “controller” for the purposes of the UK General Data Protection Regulation (“UK GDPR”) and the Data Protection Act 2018. Capitalised data-protection terms (such as “controller”, “processor”, “process”, “personal data” and “data subject”) have the meanings given in the UK GDPR.
17.1 Roles of the parties. As described in section 7, you are the account holder responsible to us under these Terms. As between you and your school, the school is the controller of student information where you act on its behalf; otherwise you are the controller. In all cases we act as a processor of that student information. Where an institution wishes to formalise this relationship (for example for procurement), we offer a separate signable Data Processing Addendum; in the event of any conflict, a signed Data Processing Addendum prevails over this section for that institution.
17.2 Scope of processing. The subject matter of the processing is the provision of the Service. The duration is for as long as you maintain an account or as otherwise set out in these Terms. The nature and purpose is to enable classroom speaking practice — namely identifying and grouping students during a lesson. The type of personal data is limited to the student information you choose to enter, typically first names or nicknames. The categories of data subjects are the students you teach. We do not require, and ask you not to enter, students’ full names, contact details, dates of birth, or other identifying information.
17.3 Our obligations. In respect of student information processed on your behalf, we will:
- process it only on your documented instructions (including those set out in these Terms and the Privacy Policy), unless required to do otherwise by law, in which case we will inform you unless legally prohibited;
- ensure that persons authorised to process it are bound by appropriate confidentiality obligations;
- implement appropriate technical and organisational measures to protect it, taking into account the state of the art and the risks of processing;
- engage sub-processors only as set out in section 17.4, and impose on each sub-processor data-protection obligations equivalent to those in this section;
- taking into account the nature of the processing, assist you by appropriate measures, insofar as possible, to respond to requests from data subjects exercising their rights;
- assist you in ensuring compliance with your obligations relating to security of processing, notification of personal data breaches, and data protection impact assessments, taking into account the information available to us;
- notify you without undue delay after becoming aware of a personal data breach affecting student information;
- at your choice, delete or return the student information at the end of the provision of the Service, and delete existing copies unless we are required by law to retain it; and
- make available to you the information reasonably necessary to demonstrate compliance with this section, and allow for and contribute to audits, including inspections, conducted by you or an auditor mandated by you, subject to reasonable notice and confidentiality.
17.4 Sub-processors. You authorise us to engage the sub-processors we use to provide the Service. Our current sub-processors are listed in our Privacy Policy (currently including Supabase, Vercel, Stripe, Resend, Sentry, Anthropic, and Voyage AI). We will give you a reasonable opportunity to object to any new sub-processor that will process student information. Student information is never shared with our AI Service Providers and is not used to generate content.
17.5 International transfers. Where student information is transferred outside the UK, we will ensure an appropriate transfer mechanism is in place, such as the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or another lawful safeguard.
